At Bellacombe we take your privacy seriously. Below we explain who controls your personal data, why we process it, who we share it with, how long we keep it and the rights you have under the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

2. Purposes and legal bases for processing

We only process your personal data for specific, lawful purposes:

  • Processing your order and the sales contract: accepting, handling, dispatching and settling your order (basis: Article 6(1)(b) UK GDPR, necessary for the performance of a contract).
  • Handling payments: carrying out your transaction securely through our payment providers (Article 6(1)(b) UK GDPR).
  • Handling returns, complaints and cancellations and answering questions sent to our customer service (Article 6(1)(b) and (c) UK GDPR).
  • Complying with legal obligations: in particular accounting and tax obligations (Article 6(1)(c) UK GDPR).
  • Sending marketing emails and our newsletter: only where you have given consent, or where permitted for existing customers under the soft opt-in rules in the Privacy and Electronic Communications Regulations (PECR). You can opt out at any time via the unsubscribe link in every email (Article 6(1)(a) and (f) UK GDPR).
  • Analytics, marketing and remarketing: cookies and advertising pixels, only on the basis of the consent you give in our cookie banner (Article 6(1)(a) UK GDPR and PECR).
  • Our legitimate interests: keeping the shop secure, preventing fraud and abuse, and establishing, exercising or defending legal claims (Article 6(1)(f) UK GDPR).

3. Categories of data we process

Depending on how you use our shop, we process the following categories of data:

  • Identity and contact details: your name, email address and telephone number.
  • Address details: your delivery address and billing address.
  • Order details: the products you ordered, order value, order number, purchase history and correspondence with us.
  • Payment details: handled by our payment providers. Bellacombe never stores your full card details.
  • Technical data: IP address, device and browser type, cookie data and browsing behaviour on our site (where you have given consent).

4. Recipients and processors

To fulfil your order we only share data with trusted parties that process it on our behalf under appropriate data processing agreements. These include:

  • Our shop platform (hosting): Shopify International Ltd., the platform on which our online shop runs.
  • Payment providers: the parties that process your payment (for example card acquirers, PayPal and Klarna), to the extent necessary to complete the transaction.
  • Couriers and fulfilment partners: the carriers and partner warehouses that pack and deliver your order (including international partners).
  • Parcel tracking service: Parcel Panel, so that we can show you the current status of your parcel (track and trace).
  • Analytics and advertising providers: pixels and cookies (for example Meta and Google), only where you have given consent in the cookie banner.
  • Our accountants and public authorities: only where the law requires it.

We never sell your personal data to third parties.

5. International transfers of your data

As we are based in the Netherlands, your data is transferred from the UK to the European Economic Area. The UK Government has recognised the EEA as providing an adequate level of data protection, so this transfer is lawful without further safeguards. Some of our service providers (for example our shop platform or logistics partners, including international warehouses outside the UK and the EEA) may process data in other countries. In those cases we put in place appropriate safeguards in line with the UK GDPR, in particular the UK International Data Transfer Agreement (IDTA) or the UK Addendum to the EU Standard Contractual Clauses.

6. How long we keep your data

  • Order data and accounting records: kept for as long as tax and accounting law requires (as a rule 7 years under the Dutch retention obligation that applies to our company, and at least 6 years for UK VAT purposes where relevant).
  • Customer account data: until you delete your account or ask us to erase your data.
  • Newsletter data: until you withdraw your consent or unsubscribe.
  • Cookie data: in line with the lifespan of each cookie as shown in the cookie banner.

7. Your rights

In relation to the processing of your data, you have the following rights under the UK GDPR:

  • the right of access to your data and to receive a copy of it,
  • the right to rectification (correction) of your data,
  • the right to erasure ("right to be forgotten"),
  • the right to restrict processing,
  • the right to data portability,
  • the right to object to processing based on our legitimate interests, including an absolute right to object to direct marketing,
  • the right to withdraw consent at any time (without affecting the lawfulness of processing carried out before withdrawal),
  • the right to lodge a complaint with the supervisory authority.

8. Supervisory authority (ICO)

If you believe we are processing your data unlawfully, you have the right to lodge a complaint with the Information Commissioner's Office (ICO), Wycliffe House, Water Lane, Wilmslow, Cheshire, SK9 5AF, telephone 0303 123 1113, ico.org.uk. We would however appreciate the chance to resolve your concern first, so please do contact us before approaching the ICO.

9. Cookies

Our shop uses cookies that are strictly necessary for the site to work and, with your consent, analytics and marketing cookies, in line with the UK GDPR and PECR.
